Mediation (in legal terms) is a form of alternative dispute resolution. It is a way of resolving disputes between two or more parties. In most cases, a third party, the mediator, assists the other parties to negotiate their own settlement. This is commonly called "facilitative mediation". Mediators might also provide evaluative mediation, where the mediator expresses a view on what might be a fair or reasonable settlement.

UNlike typical negotiaion, mediation has a greater structure, timetable and dynamics that normal negotiation lacks. The process is private and confidential. The presence of a nuetral mediator is the key differentiating feature of the process. There may be no obligation to go to mediation, but in some instances, a settlement agreement signed by the parties to a dispute will be binding on them.

Mediators aim to help the parties reach an agreement using various techniques, including to open, improve, and proper dialogue between disputants. The mediators skill and training is critical in determining success.
